Arbitration

Representation in institutional and ad hoc arbitration, drafting of the arbitration clause and enforcement of arbitral awards.

Arbitration is useful where the parties want a decision within a predictable period and before arbitrators familiar with their field. That advantage is lost, however, if the arbitration clause in the contract is badly drafted, and this is usually discovered only once the dispute has arisen.

We are involved at both stages. Before the dispute, in drafting the arbitration clause, the applicable rules, the seat and the language of the proceedings. After the dispute arises, with the request for arbitration or the defence, the handling of evidence, the hearings, and subsequently with the action to set aside or, on the contrary, with recognition and enforcement of the award.
